Seeking a divorce when one spouse won't cooperate

Filing for divorce can be one of the most difficult and painful experiences for a couple in Massachusetts. Divorce proceedings can often turn ugly, pitting two people who were once in love against each other in a courtroom battle. Couples may have difficulty acting civil toward each other when embroiled in a divorce.

In some cases, a spouse may contest a divorce by choosing to be uncooperative during proceedings. Khloe Kardashian, known for her role in the reality series "Keeping up with the Kardashians", is experiencing such treatment from her estranged husband, basketball player Lamar Odom. Kardashian filed for divorce from Odom in December of last year, but the couple has made little headway since then. Odom did not file a response to the divorce complaint and has made himself largely unavailable to the courts or to Kardashian since she filed.

Recently, due to her estranged partner's lack of response, Kardashian was told by the court that she would either need to file a Request to Enter a Default or a Request for Dismissal. The Request to Enter a Default is filed in cases such as these, where the filing party must request that the court continue with the divorce proceedings in spite of the lack of response from the other spouse. A Request for Dismissal asks the court to dismiss the divorce proceedings.

During a stressful time like the end of a marriage, it is never a good idea to give into to anger and hurt feelings. This kind of behavior generally makes the situation worse and can eliminate the possibility of a couple remaining friends after they divorce. If a Massachusetts couple feels they cannot get along during divorce proceedings, they may want to let their attorneys step in. A family law attorney is experienced in both filing court documents and keeping clients from having too much contact with their estranged partners during such an upsetting experience.

Divorce can be a difficult experience, but it is often in the best interests for many. Couples need to be able to get through the hard parts in order to be able to move on and focus on rebuilding their lives.
