Massachusetts readers may be interested to learn about the ongoing legal battles between actress Halle Berry and her ex Gabriel Aubry. The child custody case revolves around the actress's desire to move her child out of the country. Berry is engaged to Olivier Martinez, an actor, who resides in France. For safety and other reasons, the couple wishes to live primarily at his home.
The request by Berry for a relocation of her daughter Nahla was made to a court earlier this year. In the request, the actress reportedly believes that Nahla would be safer overseas due to the pressures of paparazzi following her and her family. As is his right, Nahla's father, Aubry has objected to the potential move.
Nahla has remained close to both of her parents since their split in 2010. In fact, the former couple has even spent time together with their now 4-year-old daughter. However, the pair has argued over custody of the girl before. Aubry was recently investigated for child endangerment.
Before the actress can move with her daughter to France, she must have approval of the court. As is the case with child custody cases in Massachusetts, the court will be asked to consider the reason for the relocation and all aspects of any objections. After a careful review of all evidence, it will be up to the court to decide what is in the best interests of Nahla. When divorced or separated parents, famous or not, have a desire to move away from the other parent, the proper steps must be taken to ensure the rights and wishes of both parents, as well as the needs of the child, are considered.
