Guardianship of a minor is a special role in Massachusetts

In some families, the parents of a minor child may not be equipped to continue to care for the child due to some challenge, be it legal, health related, or at worst, abuse related. In these difficult situations, a family member or close friend may need to step in and apply for guardianship.

Taking over guardianship of a minor can seem like a difficult task, but in many cases it is absolutely necessary. After all, it is not the fault of a minor child that a parent is encountering trouble that is robbing the parent of the ability to care for the child. Massachusetts law considers minor children to be some of the most vulnerable people in the population. Guardianship is a means to allow the child to stay with someone who will care for them without the need for the child to enter state-sponsored care.

Of course, a person who applies for guardianship of a minor has certain roles and responsibilities to comply with as well. And, even though a guardian may be making major decisions on behalf of the minor child in the absence of a competent parent, it is important to remember that guardianship is not the same as adoption, and that the parents of the child still retain legal rights.
