Understanding alimony and the divorce process

The divorce process is designed to help families transition and move forward with a productive future. Financial situations oftentimes change or are altered following a divorce. Sometimes the change in circumstances may create the need for alimony which is also referred to as spousal support. Massachusetts currently does not provide specific, or set, guidelines for determining alimony. Understanding how alimony is determined is helpful for parties going through a divorce.

When arriving at potential alimony and an alimony amount, the court will consider the income of both parties and several additional factors. Additional factors that may be considered can include the needs of the party that will potentially receive alimony; the ability of the party that may be required to pay alimony to pay; child care costs, expenses and child support; health care and insurance costs; and the length of the marriage.

The divorce process can sometimes feel like a process full of uncertainties which can, at times, create anxiety. By having knowledge of the divorce process, however, and how important considerations such as alimony are arrived at, the parties may better understand what to expect which can help reduce any anxiety. The proper guidance throughout the process, based on the goals of the individuals involved, can also be helpful.

The family law process seeks to provide options to help individuals through the oftentimes personal, intimate and emotional issues that may arise when divorcing. Alimony can be an important consideration for both the party seeking alimony and party who may be required to pay alimony which is why it is important to keep in mind that the family law process is designed to treat those concerns with the same importance they hold in the lives of the individuals experiencing them.
