Getting help with issues related to the guardianship of a child

For many different reasons, there may come a time in the life of a child where considerations need to be made regarding a change in the legal rights of a child. In some cases, this may mean thinking about guardianship of a child as a way of ensuring that the young one is placed in the best possible situation. However, the process of assigning guardianship will need to go through the legal system, which can be a bit daunting for those seeking help.

It is here that our firm can help. Guardianship, of course, is different than legal custody, but some of the rights are the same. The biggest difference is that the parents will retain some rights and responsibilities towards the child. However, according to the Massachusetts Guardianship Association, where the parents are not able to properly care for the child, they may voluntarily consent to the use of a guardian. In some cases, though, where the parents won't cooperate, there may be reason to seek recourse in the courts, which will require a finding that the parents are unfit.

When a guardian is in place, that person will be responsible for some major life decisions for the child. This can include choices of school, healthcare and other areas of their welfare. The guardian will handle much of the money that is to be used for the benefit of the child in daily life. However, there are limitations on who can act as a guardian, and they must be court-approved.
