How can Massachusetts child support amounts be modified?

Massachusetts child support exists so that both parents of a child are taking a part in raising the child. Child support payment amounts are determined based on the income of the parents, so that the child can live within the means that they are used to.

Child support orders come from the court, and may not be modified by the parents, unless they petition the court. Sometimes, a parent's financial circumstance may change and that parent may benefit from receiving a modification of the support they pay. While there may be any number of reasons to request modification. Some common reasons for child support modification include increased health insurance costs, inconsistencies between the amount paid and the amount that should be paid according to the Massachusetts child support guidelines, or a job loss or change of the child's living situation. Sometimes, a parent might receive better insurance and benefits from work and may want to modify support to reflect these benefits.

The parent requesting the change must file a form with the court and receive a summons to court where the parent will provide documentation supporting the change. If both parents agree to the change, the rules for modification may be simplified and will probably take less time to enact.

Parents pay child support because they want to keep the best interests of their child in mind. However, there are times when a parent's best interests also need to be considered. Attorneys who have much experience in family law understand the needs of their clients and want to help create a situation in which all parties can be satisfied. A family law attorney can be a valuable resource to any parent going through child support modification.
